Terms of Service

Effective Date: February 26, 2026

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and Hubrig Crew Marketing, LLC, a Tennessee limited liability company doing business as ActionLab Analytics ("ActionLab," "we," "us," or "our"). These Terms govern your access to and use of the ActionLab Analytics platform, including the website at actionlabanalytics.com, the dashboard application, public API, tracking script, and all related services (collectively, the "Service").

By creating an account, accessing, or using the Service in any capacity, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and "you" shall refer to both you individually and the organization.

If you do not agree to these Terms, you must not use the Service.

2. Description of Service

ActionLab Analytics is a web analytics platform that provides:

  • A lightweight, cookie-free JavaScript tracking script (under 2KB gzip) that collects anonymous, aggregated page view and event data from websites you own or operate.
  • A real-time analytics dashboard displaying visitors, page views, referrers, geographic data, device information, and custom events.
  • AI-powered insights generated by Anthropic Claude, which analyze aggregated analytics data and produce actionable recommendations.
  • An Explorer mode for event analytics, funnel analysis, cohort analysis, user flow visualization, and audience segmentation.
  • A Google Analytics 4 (GA4) import bridge for migrating historical data.
  • A public REST API for programmatic access to analytics data.
  • Team and organization management with role-based access control.

The Service is available as a hosted SaaS product at actionlabanalytics.com. These Terms govern your use of the hosted Service.

3. Account Registration

To use the Service, you must create an account by providing a valid email address and a password. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain the security and confidentiality of your account credentials, including your password and any API keys issued to you.
  • Immediately notify us at legal@actionlabanalytics.com if you suspect unauthorized access to your account.
  • Accept responsibility for all activities that occur under your account, whether authorized by you or not.

You must be at least 16 years of age to create an account. If you are under 18, you represent that you have obtained parental or guardian consent. We reserve the right to refuse registration, suspend, or terminate any account at our discretion.

4. Subscription Plans and Billing

ActionLab offers the following subscription tiers:

  • Free: $0/month -- up to 100,000 events per month, 3 sites, 3 team members, 180-day data retention.
  • Pro: $9/month -- up to 1,000,000 events per month, 10 sites, 10 team members, 1-year data retention, full Explorer, GA4 import, and API access.
  • Enterprise: $49/month -- up to 10,000,000 events per month, unlimited sites, unlimited team members, 2-year data retention, full Explorer, GA4 import, API access, and priority support.

Paid subscriptions are billed monthly in advance through Stripe, our third-party payment processor. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring monthly basis until you cancel. All fees are quoted in US dollars and are non-refundable except as required by applicable law.

You may cancel your subscription at any time through your account settings. Upon cancellation, your paid plan remains active through the end of the current billing period. After the billing period ends, your account will be downgraded to the Free tier. We do not provide pro-rated refunds for partial months.

If your payment method is declined or a charge fails, we may suspend access to paid features after a reasonable grace period. We reserve the right to modify pricing with at least 30 days' written notice. Continued use after a price change constitutes acceptance of the new pricing.

5. Free Tier

The Free tier is provided at no charge and includes the core analytics dashboard, AI insights, and tracking functionality subject to the usage limits specified in Section 4. The Free tier is subject to the same Terms as paid plans.

We reserve the right to modify the Free tier's feature set or usage limits at any time. If events exceed the monthly limit on the Free tier, additional events may be dropped without notice until the next billing cycle. We will not charge you without your explicit consent to upgrade.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:

  • Use the Service to track websites or properties you do not own or have authorization to monitor.
  • Attempt to circumvent usage limits, rate limits, or billing metering through any technical means.
  • Use the Service to collect, store, or transmit personal data of website visitors beyond the anonymous, aggregated data collected by the tracking script as designed.
  • Modify the tracking script to capture personally identifiable information (PII) such as names, email addresses, or IP addresses of your website visitors.
  • Reverse engineer, decompile, or disassemble any component of the Service infrastructure or software.
  • Introduce malicious code, viruses, or any harmful material into the Service.
  • Use the API to scrape, resell, or redistribute analytics data to third parties as a competing service.
  • Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
  • Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure.
  • Use the Service in any manner that violates applicable local, state, national, or international law or regulation.

Violation of this section may result in immediate suspension or termination of your account without prior notice.

7. Intellectual Property

The ActionLab Analytics software, including all source code, is the proprietary property of Hubrig Crew Marketing, LLC. All rights reserved.

The "ActionLab Analytics" name, logo, branding, visual design of the hosted service, and all associated trademarks are the property of Hubrig Crew Marketing, LLC. You may not use our trademarks in any manner that suggests endorsement by or affiliation with ActionLab without our prior written consent.

8. Data Ownership and Privacy

Your data belongs to you. All analytics data collected through the tracking script on your websites remains your property. We act as a data processor on your behalf. You may export or delete your data at any time.

ActionLab is designed to be privacy-first and cookie-free. The tracking script does not set cookies, does not use local storage for tracking purposes, and does not collect personally identifiable information about your website visitors. No visitor IP addresses are stored. Data collected is limited to anonymous, aggregated metrics such as page URLs, referrer domains, browser type, screen size, country (derived from IP at ingestion time and immediately discarded), and custom events you configure.

When you use the AI insights feature, aggregated analytics data is sent to Anthropic's Claude API for analysis. No personally identifiable information is included in these requests. Anthropic does not use data sent via the API for model training. Insights are cached to reduce redundant API calls.

When you use the GA4 import feature, you authorize ActionLab to access your Google Analytics data via Google's OAuth2 flow and Data API to import historical metrics into your ActionLab account. Imported data is treated identically to data collected by the tracking script.

Our collection and use of your account information (email, password hash, billing details) is governed by our Privacy Policy. We do not sell, rent, or share your data or your visitors' data with third parties except as necessary to provide the Service (e.g., Stripe for payment processing, Anthropic for AI insights).

Upon account deletion, all your analytics data, account information, and associated records will be permanently deleted within 30 days.

9. API Usage

The ActionLab public API ("API") is available to users on eligible subscription plans. API access is authenticated via API keys issued through your account settings.

API usage is subject to rate limits, which vary by subscription tier. Current rate limits are documented in our API reference and may be adjusted at our discretion. If you exceed rate limits, requests will be throttled or rejected with appropriate HTTP status codes.

You are responsible for securing your API keys. API keys should be treated as confidential credentials and must not be embedded in client-side code, committed to public repositories, or shared with unauthorized parties. You may rotate your API keys at any time through the dashboard. Compromised keys should be rotated immediately.

You may use the API to build integrations, internal tools, and applications that access your own analytics data. You may not use the API to build a service that replicates or competes with the core functionality of ActionLab Analytics.

10. Team and Organization Management

ActionLab supports multi-user access through organizations with role-based access control. The available roles are:

  • Owner: Full control over the organization, including billing, member management, site configuration, and account deletion.
  • Admin: Can manage sites, view all data, invite and remove members (except the owner), and access billing information.
  • Member: Can view analytics data and access the dashboard and API for assigned sites.
  • Viewer: Read-only access to analytics data for assigned sites.

The account owner is responsible for the actions of all team members within the organization. Team member limits are determined by your subscription tier. Invitations are sent via email and expire after a reasonable period.

11. Service Availability and SLA

We strive to maintain high availability of the Service but do not guarantee any specific uptime percentage. The Service is provided on a "best-effort" basis.

We may experience downtime due to scheduled maintenance, unscheduled maintenance, infrastructure failures, third-party service outages, or force majeure events. We will make reasonable efforts to notify users of planned maintenance in advance when possible.

During periods of Service unavailability, the tracking script is designed to fail silently without affecting the performance or functionality of your websites. No analytics data will be collected during downtime, and such data cannot be recovered retroactively.

ActionLab does not offer a formal Service Level Agreement (SLA) with guaranteed uptime or financial credits for downtime.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HUBRIG CREW MARKETING, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF BUSINESS OPPORTUNITIES, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

AI-generated insights are provided for informational purposes only and do not constitute professional advice. We make no representations or warranties regarding the accuracy, completeness, or reliability of AI-generated content. You are solely responsible for any decisions made based on AI insights.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Hubrig Crew Marketing, LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

  • Your use of the Service or any activity under your account.
  • Your violation of these Terms.
  • Your violation of any applicable law, regulation, or third-party right.
  • Any data you collect through the Service, including any claim that such data collection infringes the privacy rights of any third party.
  • Any content, material, or information you submit to, transmit through, or store on the Service.

We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims.

14. Termination

By you: You may terminate your account at any time by contacting us at legal@actionlabanalytics.com or through the account settings in the dashboard. Upon termination, your right to use the Service will cease immediately. If you are on a paid plan, cancellation takes effect at the end of the current billing period.

By us: We may suspend or terminate your account at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to: violation of these Terms, non-payment of fees, extended inactivity, abusive behavior toward our staff or systems, or if we reasonably believe your use of the Service poses a security risk.

Upon termination, all data associated with your account will be scheduled for permanent deletion within 30 days. You are responsible for exporting any data you wish to retain before account termination. We are not obligated to maintain or provide any data after termination.

Sections 7 (Intellectual Property), 8 (Data Ownership and Privacy), 12 (Limitation of Liability), 13 (Indemnification), 16 (Governing Law), and 17 (Dispute Resolution) shall survive termination of these Terms.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email (to the address associated with your account) or by posting a prominent notice on the Service at least 30 days before the changes take effect. Non-material changes (such as clarifications or formatting updates) may be made without prior notice.

The "Effective Date" at the top of this document will be updated to reflect the date of the most recent revision. Your continued use of the Service after the effective date of any modification constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service and terminate your account.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, United States of America, without regard to its conflict-of-law provisions. You consent to the personal and exclusive jurisdiction of the state and federal courts located in the State of Tennessee for the resolution of any disputes arising out of or relating to these Terms or the Service.

You agree that any cause of action or claim you may have arising out of or relating to these Terms or the Service must be commenced within one (1) year after the cause of action accrues. Otherwise, such cause of action or claim is permanently barred.

17. Dispute Resolution

Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at legal@actionlabanalytics.com. We will make a good-faith effort to resolve the dispute within 30 days of receiving your notice.

If the dispute cannot be resolved informally, either party may pursue resolution through binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules, unless you opt out of arbitration by providing written notice to legal@actionlabanalytics.com within 30 days of accepting these Terms. The arbitration shall be conducted in the State of Tennessee. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

You and ActionLab agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, both parties waive any right to a jury trial.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.
